Welcome to Big Lap. By using our website and services, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Big Lap (big-lap.com.au), you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree, please don't use the service.
2. Description of Service
Big Lap is a free travel mapping service that allows you to:
- Document your Australian road trip with photos and markers
- View points of interest (toilets, fuel stations)
- Share your journey via links to social media platforms
The service is provided free of charge. We reserve the right to modify, suspend, or discontinue the service at any time.
3. Account Registration
To use certain features, you must create an account (via email magic link or Facebook Login). By doing so, you:
- Confirm you are at least 13 years old
- Agree to provide accurate information
- Are responsible for maintaining the security of your account
- Are responsible for all activity under your account
4. User Content
You retain ownership of photos and content you upload. By uploading content, you grant us a licence to:
- Store and display your content within the Big Lap service
- Create thumbnails and process images for the map display
- Generate shareable links with preview metadata
This licence ends when you delete your content or account.
5. Content Standards
You agree not to upload or share content that:
- Contains nudity, sexual content, or explicit material
- Is violent, threatening, or promotes harm
- Is hateful, discriminatory, or harasses others
- Infringes on intellectual property rights
- Contains malware or malicious code
- Is spam or commercial advertising
- Violates any applicable law
6. External Sharing
When sharing links to external platforms (Facebook, Twitter, etc.):
- Shared links are subject to each platform's terms of service
- External platforms may cache preview images from your marker pages
- You are responsible for any posts you make on external platforms
- You can delete your posts directly on those platforms
7. Intellectual Property
The Big Lap service, including its design, code, and branding, is owned by us and protected by copyright. Map data is provided by:
- OpenStreetMap contributors (map tiles)
- National Public Toilet Map (toilet data)
- Geoscience Australia (fuel station data)
You may not copy, modify, or distribute our service without permission.
8. Accuracy of Information
We strive to provide accurate POI data, but we cannot guarantee:
- That all locations are current or accurate
- That facilities (toilets, fuel) are operational
- That information is complete or up-to-date
Always verify important information independently, especially in remote areas.
9. Disclaimer of Warranties
Big Lap is provided "as is" without warranties of any kind. We do not warrant that:
- The service will be uninterrupted or error-free
- The service will meet your requirements
- Any errors will be corrected
10. Limitation of Liability
To the maximum extent permitted by Australian law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us (which is zero for a free service)
- We are not liable for any loss of data, photos, or content
Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages arising from:
- Your use of the service
- Your violation of these terms
- Content you upload or share
12. Termination
We may suspend or terminate your account at any time if you violate these terms. You may delete your account at any time through the app settings or by contacting us.
Upon termination:
- Your access to the service will end
- Your data will be deleted within 30 days
- Links you've shared externally remain on those platforms (you must delete them separately)
13. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of significant changes.
14. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
